Kolkata: Calcutta High Court Justice Shampa Sarkar on Wednesday had instructed Election Commission to preserve all the EVMs and VVPAT machines and other election-related materials secure till August 12 which is the next hearing date of the Nandigram recounting case.
“The petition filed by Chief Minister Mamata Banerjee was without any defect,” said Justice Sarkar.
The Calcutta High Court also directed to serve a notice to Leader of Opposition Suvendu Adhikari, who defeated Mamata Banerjee in the Nandigram seat.
It can be recalled that following Chief Minister Mamata Banerjee’s plea Justice Kaushik Chanda recused himself from Nandigram case and ahead of recusal from Nandigram recounting case, Justice Kaushik Chanda fined 5 lakh rupees to Chief Minister Mamata Banerjee for questioning the judiciary.
As Justice Chanda was seen attending BJP’s programs, TMC supremo feared biased verdict and appealed for his recusal. Incidentally, the saffron camp leaders including the party chief Dilip Ghosh had several times claimed that Justice Kaushik Chanda has no connection with the BJP.
Meanwhile, Suvendu Adhikari moved Supreme Court over the Nandigram recounting case fearing that TMC supremo Mamata Banerjee can influence the verdict of the case in Calcutta High Court.
According to close aide of Suvendu it was learnt that Suvendu appealed before the apex court to transfer the case to the high court of any states as he thinks the way Justice Kaushik Chanda was forced to step down from the division bench, the verdict of Calcutta High Court might also be influenced.
