Free Press Journal, ‘Mumbai Police on Rhea’s side’

Given the sensitivity of the matter, interstate ramification, and the presence of most of the accused in Mumbai, actor Sushant Singh Rajput’s suicide case must be probed by the Central Bureau of Investigation, the Bihar government told the Supreme Court on Friday. The state also claimed that Mumbai Police has deliberately been obstructing Bihar Police from investigating the case.

This comes on the heels of an affidavit filed by the Bihar government in response to the plea filed by actress Rhea Chakraborty, seeking to transfer the probe in the FIR lodged against her by Sushant's father with the Patna Police to Mumbai.

The affidavit filed by Upendra Sharma (36), Senior Superintendent of Police states that Rhea's plea seeking transfer of the probe is premature, misconceived and non-maintainable.

In his affidavit, Sharma has blamed the Mumbai Police of not cooperating with the probe in the FIR lodged at Patna.

"Mumbai Police refused to co-operate and provide necessary support for reasons best known to them. IPS Vinay Tiwari, the city superintendent of police, Patna (Central) was forcibly quarantined by the BrihanMumbai Municipal Corporation (BMC) despite the fact that he was on official duty in connection with the probe. His forcible quarantine is nothing but a result of afterthought on the part of the Mumbai Police, which was aimed at obstructing the probe by the Patna Police," the affidavit reads.

Bihar Police has further pointed out that four of its other officers, who visited Mumbai, were not quarantined like Tiwari.

"This fact casts a serious aspersion on the role of the Mumbai Police, which is apparently siding with Rhea for reasons best known to them. They haven't supplied any documents such as inquest report, autopsy report, FSL report, and CCTV footage, amongst others, to us, despite several requests. Mumbai Police has been making lame excuses that only it has the jurisdiction to investigate the offence," Sharma has said in his affidavit.

The affidavit further goes on to state that despite no cooperation from the Mumbai Police, the Bihar cops have managed to examine various witnesses and have verified the Kotak Bank account details of Sushant, from which Rhea allegedly siphoned off certain amounts.

The affidavit further states that the provisions of CrPC does not permit the transfer of probes from one state to another state, especially at a primary stage of investigation. "A mere

apprehension of bias is no ground to transfer proceedings. Transfer should be allowed only when there is well substantiated apprehension that justice will not be dispensed impartially, objectively and without any bias," the affidavit reads.
